Privacy Policy

COUTURE, Inc. (also referred to as COUTURE K.K. or COUTURE kabushiki kaisha in Japan) and its affiliates are hereafter named “Couture”.

Couture offers several services and products, including:

  • Services to individuals, such as digital rights management for content creators who wish to collaborate with brands globally
  • Services to companies, enterprises operating brands that wish to understand their audience, discover content, collaborate with content creators in multiple languages and negotiate with content creators to obtain digital rights.

Couture offers these services and information related to its services through various channels, including:

  • Any websites or sites offered by Couture, including without limitation, and including all subdomains, present and future (the “Website”)
  • Other domains which sell Couture-branded products and services (the “Affiliate Shops”)
  • The suite of mobile or web applications, that Couture makes available from time to time (the “Applications”)
  • The server-side technology that powers the suite of Applications (the “Platform”)

We call the Website, Applications, Platform and Affiliate Shops together the “Services“.

Couture is committed to protecting the privacy of all individuals who make use of our Services. Any identifiable individual who uses our Services may be referred to as “User”.

Our Users may be split broadly into the following categories: Brand User, Content Creator User and Other User. We will treat Personal Information of any type of User equally. Therefore Couture does not distinguish certain properties of Personal Information being collected by User category. This means that any references to “Brand” or “Content Creator” throughout this Privacy Policy are for informational purposes only and do not have any material impact on the treatment of Personal Information (for a particular User category).

Depending on the Services provided by Couture to the User, the User may have an “Account” on our Platform in which certain Personal Information may be collected and stored.

Supported Media & Third-Party Services

The Services by their nature allow our Users to connect their Account (on the Couture Platform) to various third party services such as social networks, blogging platforms and websites related to the User. These third party services will be referred to as “Supported Media” throughout this document.

Our Platform may also connect to, interact with and exchange personal information with the APIs of other services developed by third parties that Couture does not own or control (“Third-Party Services”) in order to deliver The Services to our Users. This includes, but not limited to, payment processing services, real-time push notification services, translation platforms, data analytics services, user management services, etc. When we refer to the broader Third-Party Services throughout this document, that includes the Supported Media.

Social Identity

A User may have accounts on multiple Supported Media to which the Couture Platform is connected. In order to avoid ambiguity between a User Account on our Platform and any other Accounts the User may have with 3rd party services we will refer to Personal Information created, stored and maintained by a User on a Supported Medium as a “Social Identity”. Users can thus have several Social Identities, recognized by and connected to the Couture Platform.

Personal Information

Throughout this Privacy Policy, we refer to “Personal information”, which means information related to the User or other identifiable individuals, or an opinion about an identified individual, or an individual who is reasonably identifiable whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.

Your registration and account information, full name, gender, date of birth, home address, home telephone number, mobile telephone number, email address and workplace contact details are examples of information which may constitute personal information. Personal information may also include information we may collect about your individual preferences or information collected from Social Identities on Supported Media.

Protecting the safety of children when they use the Internet is very important to us. Our Services should only be accessed by individuals of Minimum Age. “Minimum Age” means 16 years old in all countries where Couture Services are made available. However, if applicable law requires that you must be older than such ages in order for Couture to lawfully provide the Services to you (including the collection, storage, and use of your information in accordance with this Privacy Policy), then the Minimum Age would be such older age. The Services are not designed nor intended for use by children or anyone else under the age of 16.

User Content

Couture is a social media management Platform for both Brands and Content Creators. By its nature, the Services enable our Users to bring together their social networks and streamline workflow. The Services help our customers to discover content, manage digital rights and understand their audience. Accordingly, we only use User Content to provide the Services to our Users in accordance with the lawful instructions they give us through the Services.

In particular, when our Users link a Supported Medium to their Couture Account, our Users can choose to instantly collect, process, share and access such Supported Media via their Couture Account (subject to the terms of the license agreements with the Supported Media).

In this way, our Users can obtain, use and analyze public Personal Information from linked Supported Media and also create, input, submit, post, transmit, store, view or display Personal Information through the functionality of the Services.

Except as provided in this Privacy Policy, Couture does not divulge any Personal Information gathered via the Services (including User Content) to third parties. Notwithstanding anything in the Privacy Policy to the contrary, we may share any information we have collected about you:

(1) when you explicitly consent to the disclosure of such information to a third party when connecting to a Third-Party Service that asks you if you consent to such sharing;

(2) where we are legally required to do so, such as in response to court orders or legal process, or to establish, protect, or exercise our legal rights or to defend against legal claims or demands;

(3) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person;

(5) to a parent company, subsidiaries, joint ventures, or other companies under common control with Couture;

(6) if we are acquired by or merged with another entity (in which case we will require such entity to assume our obligations under this Privacy Policy or inform you that you are covered by a new privacy policy); and

Subject to obligations consistent with this Privacy Policy, we may also disclose information to our affiliates, agents, contractors, and service providers in order to facilitate the functioning of the Services or to perform tasks that are integral to the Services, such as processing transactions, fulfilling requests for information, or providing support services or other tasks, from time to time. Information may also be transferred from Couture to the third parties in control of the Supported Media, but only to the extent required in order for the Services to function properly.

Cookies & related technologies

Cookies are small text files placed on your device when you visit a web site, in order to track use of the site and to improve your user experience.

Couture uses tracking technology (“cookies”) on the Website, in the Applications, and in the Platform, including mobile application identifiers and a unique Couture user ID to help us recognize you across different Services, to monitor usage and web traffic routing for the Services, and to customize and improve the Services. By visiting the Website or using the Services you agree to the use of cookies in your browser and HTML-based emails.

Session Cookies

The Services use “session cookies”, which improve your user experience by storing certain information from your current visit on your device, such as login information. These enable us to remember your login session so you can move easily within the Website, Applications or other Services. Without these session cookies, we wouldn’t be able to provide the Services to you. These session cookies have limited functionalities and expirations, and you will be required to re-enter your Couture login information after a certain period of time has elapsed to protect you against others accidentally accessing your Account contents and related Personal Information. Other examples of our use of session cookies include to track the number of visits by a particular visitor to a page and to store items in an online shopping cart for the Shop.

Performance & Remarketing Cookies

Partners who help us serve advertising on and off the Website and analytics companies may also put cookies on your device. We use several third-party vendors to help deliver ads for relevant Couture products and services to you when you visit certain pages on our Website and then visit certain third-party sites. We may share with third-party ad partners a cryptographic hash of a common account identifier (such as an email address), to help us measure and tailor ads and services provided to you. Please note that this Privacy Policy covers only our use of cookies and does not include use of cookies by any third parties.

Couture may also use related technologies including web beacons, bugs, pixels, and software tokens in order to facilitate your use of the Services. Most notably, the Services use software tokens (stored securely on third party servers) in order to facilitate the logging in to and the functioning of Supported Media.

Most computer and some mobile web browsers automatically accept cookies but, if you prefer, you can change your browser to prevent that or to notify you each time a cookie is set. Please note however that, by blocking or deleting cookies, you may not be able to take full advantage of our Services. If you do not want to receive tracking pixels, you will need to disable HTML images in your email client, and that may affect your ability to view images in other emails that you receive.

We use industry best practices to keep any information collected and/or transmitted to the Supported Media or Third-Party Services secure. This includes the use of HTTPS with TLS (Transport Layer Security), which encrypts all transmitted data, and OAuth 2.0 protocols for authentication and data transfer to Supported Media.

Certain Personal Information, most notably Couture login details, is encrypted during transmission using TLS. Once validated within our system, passwords are deleted from our system.

When payments are processed via credit card, Couture uses third-party vendors that are PCI-DSS Compliant. At no point does Couture have access to your credit card information.

Also bank account details provided by Users via our Services are never stored on the Couture Platform and are transmitted in encrypted forms using TLS directly from a User’s device to the Third-Party Service, such as payment processors, handling the bank account data.

You should bear in mind that submission of information over the Internet is never entirely secure. We cannot guarantee the security of information you submit via the Services whilst it is in transit over the Internet and any such submission is at your own risk.

If you are a logged-in User, it is advisable that you logout of your account at the end of every session and not leave a logged-in Account unattended for any period of time, particularly if you use a shared computer or device.

Information storage and international transfers

COUTURE, Inc., the entity which provides the Services, is a Japanese company with its head-office located in Tokyo, Japan. The Services are mainly provided from our offices in Japan. However, by the very nature of the Services, the data that is viewed, collected, stored or posted on or through the Services also needs to flow from wherever you are located in the world, to where our Platform is storing the same data (i.e. in most cases, in the United States).

In addition, Third-Party Services may process, or store, the same Couture Data or User Content on servers outside of Japan, including the US. By using any of the Services, or submitting or collecting any Personal Information via the Services, you authorize Couture and its authorized service partners to use and process Couture Data and User Content (including any Personal Information) in these countries. Please be aware that the privacy protections and the rights of authorities and Government agencies to access your Personal Information in some of these countries may not be equivalent to those in your country.

Your rights

You can contact us to obtain a copy of the Personal Information held about you by us. This may be subject to a fee not exceeding any prescribed fee permitted by applicable law. You can also ask us to correct and, where relevant, erase that information. Please note that certain Personal Information may need to be retained by Couture for a period of time following cancellation of your account where this is necessary for our legitimate business purposes or required or authorized by applicable law.

You should be aware that Couture acts as a conduit between our users and the various Supported Media. In several instances, the content published via Couture will not be in Couture’s custody or control, and any content that has been shared by you through any Supported Media via the Services may continue to be available to third parties and the public at large, as this content is now under the control of the operators of the Supported Media.
